En este artículo presentamos las principales corrientes de la Filosofía Experimental y atendemos a una de las críticas más severas a la que se ha sometido este reciente programa de renovación metodológica. Según Antti Kauppinen la Filosofía Experimental está condenada al fracaso porque no puede obtener mediante sus métodos el tipo de intuiciones que interesan a los filósofos –las intuiciones robustas del hablante competente. Aun aceptando parte de las críticas de Kauppinen, en este artículo sostenemos, en primer lugar, que la (...) supuesta incapacidad de la Filosofía Experimental para acceder a las intuiciones robustas de los hablantes tiene que ver en gran medida con los métodos experimentales empleados hasta ahora por los filósofos experimentales. En segundo lugar, defendemos que el proyecto de reforma llevado a cabo desde la Filosofía Experimental resultará viable solo si se adoptan una serie de consejos metodológicos procedentes de la economía experimental. Únicamente entonces podrán los experimentalistas responder con éxito a la objeción de Kauppinen. (shrink)

El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. We very often discover ourselves engaged in inner speech. It seems that this kind of silent, private, speech fulfils some role in our cognition, most probably related to conscious thinking. Yet, the study of inner speech has been neglected by philosophy and psychology alike for many years. However, things seem to have changed in the last two decades. The paper argues that grounding is neither irreflexive, nor asymmetric, nor transitive. In arguing for that conclusion the paper also arguesthat truthmaking is neither irreflexive, nor asymmetric, nor transitive.

In this paper, I analyse EE I 6, where Aristotle presented a famous methodological digression. Many interpreters have taken this chapter as advocating a dialectical procedure of enquiry. My claim is that Aristotle does not keep a dialectical attitude towards endoxa or phainomena in this chapter. In order to accomplish my goal, I shall show that EE I 6 does not provide enough evidence for the dialectical construal of it, and that this construal, in turn, hangs on some assumptions brought (...) out from other Aristotelian works (EN and Top.), which do not provide good evidence as well. By the analysis of these assumptions, I intend to show that Aristotle is not carrying out any sort of dialectic, especially dialectic conceived as conceptual analysis seeking the salvage of phainomena or endoxa. El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. In his "Resemblance Nominalism and counterparts" Alexander Bird objects to my claim that the truthmakers of ´a and b resemble each other´ are just a and b. In this paper I respond to Bird´s objections.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' The study aimed to comprehensively overview the experiences encountered by public school employees during the recruitment, selection, and placement (RSP) process within the DepEd Bohol Division. Employing a qualitative-descriptive research design, the researchers utilized a phenomenological approach to delve deeply into these experiences, shedding light on the nuances and intricacies of the division's RSP process. As Lambert et al. (2013) described, qualitative- descriptive studies aim to provide a comprehensive and detailed summary of specific events experienced by individuals or groups in (...) everyday terms. To achieve this, Colaizzi's (1978) data analysis method was applied, meticulously gathering, transcribing, and analyzing recorded participant responses. The rigorous analysis revealed that an overwhelming 81% of the participants recognized significant challenges within the current RSP system of the division, underscoring the pressing need for a renewed approach to address these identified challenges. This highlighted the necessity for an RSP policy that is responsive and innovative, tailored to meet the evolving needs and expectations of applicants, schools, and the division. By implementing improvements to the RSP process, a more efficient and timely filling of vacated and newly available positions is anticipated, contributing to the seamless functioning of the educational system and ultimately enhancing the prospects of success. This article deals with the relationship between language and thought, focusing on the question of whether language can be a vehicle of thought, as, for example, Peter Carruthers has claimed. We develop and examine a powerful argument—the "argument from explicitness"—against this cognitive role of language. The premises of the argument are just two: (1) the vehicle of thought has to be explicit, and (2) natural languages are not explicit. We explain what these simple premises mean and why we should believe (...) they are true. Finally, we argue that even though the argument from explicitness shows that natural language cannot be a vehicle of thought, there is a cognitive function for language. (shrink)

Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. According to the thesis of semantic underdetermination, most sentences of a natural language lack a definite semantic interpretation. This thesis supports an argument against the use of natural language as an instrument of thought, based on the premise that cognition requires a semantically precise and compositional instrument. In this paper we examine several ways to construe this argument, as well as possible ways out for the cognitive view of natural language in the introspectivist version defended by Carruthers. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. This research tackled the challenges public secondary schools in Sagbayan District, Bohol, faced regarding records management. The study employed a mixed research design, combining both descriptive-qualitative and descriptive- quantitative methods. The qualitative phase involved conducting in-depth interviews and focus group discussions with relevant stakeholders involved in records management. On the other hand, the quantitative phase utilized survey questionnaires to gather data from relevant stakeholders to determine the acceptability of the proposed MIS among end-users. The first phase findings revealed various challenges (...) in records management faced by the schools, such as inefficient manual record-keeping systems, difficulties in data retrieval, and the risk of data loss due to inadequate backup procedures. These challenges highlighted the need for a comprehensive, technology-driven solution to streamline records management processes and ensure data security. The evaluation results in the second phase showed that the developed Management Information System (MIS) was well-accepted among the end users. The absence of any significant difference in the level of acceptability among the participants further validated the system's suitability for addressing their specific needs. The successful implementation of the MIS proved to be an effective solution to the records management challenges faced by the public secondary schools in Sagbayan District, Bohol. (shrink)

In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) Sufficient Reason (sect. 3), some attempts to demonstrate the Principles of Contradiction and Sufficient Reason (sect. 4), and one attempt to demonstrate the Principle of Identity of Indiscernibles (sect. 5). In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

O presente artigo tem por objetivo caracterizar as duas fases do pensamento bachelardiano intituladas diurna e noturna e o modo como determinadas noções que permeiam as duas etapas da filosofia do autor configuram uma comunicação recíproca entre elas, fazendo com que haja uma troca assídua de valores entre ambas as vertentes. Deste modo, tentar-se-á demonstrar o quanto o fluxo de uma fase a outra de seu pensamento denota um sentido de completude ao invés de desconexão, negação ou mesmo oposição. Conceitos (...) como descontinuidade, imagem e tempo orientarão nosso esforço em evidenciar tal complementariedade e aproximação entre as duas fases de pensamento de Gaston Bachelard. (shrink)

Nesse artigo, eu procuro mostrar que a leitura tradicional que atribui um procedimento dialético à abordagem aristotélica da acrasia, em Ética Nicomaquéia VII 1-3 provoca um sério problema interpretativo ao tentar compatibilizar a posição socrática acerca da acrasia e os phanomena. Primeiramente, tento mostrar, baseando-me numa análise de Tópicos I 1-2, que o procedimento metodológico, em EN VII 1 1145b2-7, não se caracteriza como dialético. Em segundo lugar, proponho uma leitura em que Aristóteles, passo a passo refuta a tese socrática (...) que nega a existência da acrasia, uma vez que esse tese não é contada entre os phainomena que se quer preservar. In the Discourse on Metaphysics Leibniz put forward his famous complete-concept definition of substance. Sometimes this definition is glossed as stating that a substance is an entity with a concept so complete that it contains all its predicates, and it is thought that it follows directly from Leibniz’s theory of truth. Now, an adequate definition of substance should not apply to accidents. But, as I shall point out, if Leibniz’s theory of truth is correct then an accident is an entity (...) with a concept so complete that it contains all its predicates. The aim of this paper is to clarify Leibniz’s notion of substance in the Discourse with a view to explaining how that definition successfully distinguishes between substances and accidents. (shrink)

The article explores critical elements to understand how Origen elaborates his mystical theology in his Commentary on John. The spiritual progress process implies that rational beings are guided, by God’s Logos, from the practical life to the theoretical one becoming son or daughter of God, in the likeness of the Logos. This process aims at knowing the Father as he is known by the Logos. The article has two parts: 1. The main objective of this paper is to address the problem of the philosophical method, which consists of the lack of consensus among philosophers regarding the proper procedure to carry out this human activity. In this sense, it examines a few methodological proposals put forward by some representatives of contemporary philosophy, emphasizing the impact that the development of modern science has had on such views. In addition, the plausibility of such proposals is assessed.

My aim in this paper is twofold: I will try to clarify what the conditions developed in EN I a discipline or an argument must meet to be assumed as precise are, and, then, try to present evidence that the exam of akrasia in EN VII 3 meets these conditions. In the first part of this paper, I will select passages in which such conditions are displayed, and also distinguish between practical precision and theoretical precision. In the second part, where (...) the analysis of the senses of having but not using knowledge in EN VII 3 is carried on, I will claim that Aristotle’s objective is reaching the adequate statement of the explanandum that will be the subject of causal enquiry of akrasia. My concluding remarks will claim that the conditions displayed in this paper’s first part are met by Aristotelian procedure in EN VII 3. (shrink)

El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—. Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. This paper is a philosophical discussion about the link between utopianism and responsibility. It argues that our time demands a strong practice of political responsibility in both organizations and society based on what has been called ‘real utopianism’. It takes as a starting point Hans Jonas’ critique of utopianism. Keeping in mind the horrors of the Second World War this Jewish thinker disconnected the principle of responsibility from the idea of utopianism, and connected it to a ‘heuristics of fear’ – (...) we should be careful with ‘wild’ new technologies, but also with new utopian perspectives. In a second step Jonas’ predecessors and utopian thinkers Martin Buber, Ernst Bloch and Ernest Callenbach are revisited. They show that a fully conceptualized idea of utopianism includes at least three dimensions of responsibility: subsistence, justice and spirituality. I then argue that if one digs deeper into the work of Jonas, it seems that the concept of responsibility in fact implies the courage to overcome a heuristics of fear. This paper therefore argues that there is no need to radically disjunct responsibility from utopianism and that the concept of responsibility actually opens a path to ‘real utopianism’. Such a concept of responsibility can best be supported by a confessionally neutral but nonetheless spiritual eco-humanist worldview that develops a new attitude towards nature, in which (eco)asceticism, morality and spirituality become intertwined. Multiplicity of Beings according to Saint Thomas Aquinas is a book that aimed to find an explanation of beings' diversity on the grounds of the metaphysical intrinsic principles of beings identified by Aristótle. Are matter and form causes of identity, individuation and diversity of substances? Aquinas answers this question by means of some demonstrations grounded on the very nature of matter and form, in the line of the doctrines contained in book 7 of the Aristotle's Metaphysics.

¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

El pasado 8 de junio 2020, Fernando Soler Escalona, estudiante de nuestra Facultad, obtuvo el grado académico de Doctor en Teología, con una tesis sobre El sentido teológico de las metáforas de comer y beber en la obra de Orí-genes, redactada bajo la supervisión de Samuel Fernández, Profesor Titular de Patrología. La defensa fue inusual: la pandemia de COVID-19 obligó a realizarla por videoconferencia, para mantener el aislamiento físico entre los participantes. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. In this paper it is explored the relationship between the practice of philosophy and the development of a sort of professional intuition through it. That is to say, this paper is broadly concerned with a very traditional metaphilosophical topic, namely, the sort of abilities a skillful philosopher must possess to excel at philosophizing. More precisely, it critically examines the long-held common place in philosophy according to which the competences acquired through philosophical training are related to applying concepts. Such a view (...) has given way to the idea that philosophers gain expert intuitions -provided by philosophical training- about using concepts. In this sense, it has been shown in experimental philosophy that philosophers holding this notion of the practice of philosophy might be under the illusion of expertise. For these reasons, we argue, based on the work of the psychologist Deanna Kuhn, that philosophical expertise, on a more positive account, might be related to the evaluation, construction, and rebuttal of arguments. With this in mind, we also explore the relationship between intuition and arguments in philosophy. (shrink)

We perform an experimental investigation using a dictator game in which individuals must make a moral decision —to give or not to give an amount of money to poor people in the Third World. A questionnaire in which the subjects are asked about the reasons for their decision shows that, at least in this case, moral motivations carry a heavy weight in the decision: the majority of dictators give the money for reasons of a consequentialist nature. Based on the results (...) presented here and of other analogous experiments, we conclude that dicator behavior can be understood in terms of moral distance rather than social distance and that it systematically deviates from the egoism assumption in economic models and game theory. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

The concept of non-arbitrage plays an essential role in finance theory. Under certain regularity conditions, the Fundamental Theorem of Asset Pricing states that, in non-arbitrage markets, prices of financial instruments are martingale processes. In this theoretical framework, the analysis of the statistical distributions of financial assets can assist in understanding how participants behave in the markets, and may or may not engender arbitrage conditions. Assuming an underlying Variance Gamma statistical model, this study aims to test, using the FBST - Full (...) Bayesian Significance Test, if there is a relevant price difference between essentially the same financial asset traded at two distinct locations. Specifically, we investigate and compare the behavior of call options on the BOVESPA Index traded at (a) the Equities Segment and (b) the Derivatives Segment of BM&FBovespa. Our results seem to point out significant statistical differences. To what extent this evidence is actually the expression of perennial arbitrage opportunities is still an open question. (shrink)

Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition.
